What is a Quiet Title?
Sometimes Title to real estate is not marketable…

Sometimes Title to real estate is not marketable.  This means there is a problem or a defect, cloud or encumbrance or other question about the status of the Title and who actually owns the property.  A lawsuit filed in the Equity Division of the Circuit Court of the County in which the real estate is located sometimes is the only option to clearing Title.

These lawsuits are called Quiet Title actions.  Quiet Title actions in Missouri require an experienced Attorney knowledgeable about the procedures with the Court in order to make certain that all interests are covered.

 

Examples of when Quiet Title actions occur have to do with competing claims among heirs to property, issues over boundary disputes as to land or after tax sales.
